1. Who we are
Clinically Clear is a Florida-licensed women's telehealth practice operated by Shelbi Arcand, NP. This Privacy Policy describes how we collect, use, and protect information from visitors to clinicallyclear.info and from patients of the practice once it launches.
2. Information we collect
From visitors to this website
- Information you provide — name, email, phone, and other details you enter into the waitlist or contact forms.
- Standard server / analytics data — IP address, browser type, referring URL, pages visited. Used to understand site usage and improve the site.
- Cookies / local storage — used minimally; the waitlist form may temporarily store submitted data in your browser's local storage during pre-launch.
- Consent audit trail — when you opt in to email or SMS on the waitlist form, we record an audit trail required by federal SMS rules (A2P 10DLC) and good privacy practice: the consent version and the exact opt-in language shown to you, the consent timestamp, the page URL where you consented, and basic browser info (user-agent, language, time zone, screen size). This is used only to demonstrate proper consent if asked by carriers, regulators, or you.
From patients (at launch)
- Identifying information — name, date of birth, contact information, insurance details (if applicable).
- Health information — symptoms, history, medications, lab results, anything shared during a visit. This is Protected Health Information (PHI) under HIPAA.
- Visit recordings / transcripts — only if explicitly disclosed and consented to in advance.
3. How we use information
- Provide and improve the website and (at launch) clinical services
- Communicate with you about your appointments, care plans, and follow-ups
- Send the launch announcement and (with consent) ongoing practice updates
- Comply with legal and regulatory obligations
We do not sell or rent personal information to third parties for their marketing.
4. How we share information
We share information only as needed to provide care and operate the practice, including:
- Service providers — secure technology vendors (telehealth platform, EHR, scheduling, payment processing, email/SMS delivery) under business associate agreements where PHI is involved.
- Other clinicians — when you request a referral or release of records to another provider.
- Legal requirements — when required by law, subpoena, or court order, or when necessary to prevent serious harm.
5. Your rights
- Access & correction — you can request a copy of your records and ask us to correct inaccuracies.
- Deletion — you can ask us to delete information we've collected, subject to clinical record-retention requirements under Florida law.
- Opt-out of marketing — every email contains an unsubscribe link; you can opt out of SMS by replying STOP.
- Complaints — you can file a complaint with us directly or with the U.S. Department of Health and Human Services Office for Civil Rights.
6. Security
We use commercially reasonable safeguards — secure transmission, access-controlled clinical systems, and HIPAA-aware vendors — to protect your information. No system is 100% secure; if we become aware of a breach affecting your information, we'll notify you in line with applicable law.
7. Children's privacy
Clinically Clear's services are intended for adult women (18+). We do not knowingly collect information from individuals under 18 through this site.
8. Changes to this policy
We'll update this page when our practices change. Material changes will be communicated to active patients through the contact information on file.
